Liability For New York Tow Truck Accidents

Pedestrian collisions have become increasingly common across New York City. According to PIX 11, “New York City is the deadliest city for pedestrians in the United States […]. New York City ranked the highest among U.S. cities with 1,260 pedestrian deaths between 2011 and 2020, followed by Los Angeles (1,133 deaths), Phoenix (717 deaths), Houston (647 deaths) and Dallas (501 deaths).” There are a number of factors that could contribute to a pedestrian collision.

Speeding
Distracted driving
Inclement weather
Driver fatigue

The vast majority of pedestrian collisions are avoidable and involve some amount of driver error. Pursuant to New York Vehicle Code 1146, all drivers must exercise due care to avoid hitting pedestrians, bicyclists and domestic animals in the roadway. When a driver fails to slow down to avoid hitting pedestrians, this could form the basis of a negligence claim. It is important that certain steps are taken after any car accident.

A police report of the incident should be created.
Eye witnesses should be interviewed.
Surveillance footage should be sought.
A thorough investigation should be conducted.

If a tow truck driver was working at the time of a collision, their employer could be held at fault. Generally speaking, companies are liable for the wrongful actions of their employees – insofar as those employees were working within the course and scope of their job duties. The family of any person that died in a collision may be able to seek some measure of justice through a civil claim.
